
DBA has thousands of hours of research experience in nationwide complex litigation involving product liability defense, especially in medical and consumer product areas such as breast implants, Rezulin, Fen-phen, cosmetics, lead paint, tobacco, dietary aids, Epivir/Retrovir, Paxil and Lotronex. Our tasks included researching experts, finding government and other regulatory documentation and researching plaintiff backgrounds.
In the nationwide breast implant litigation, DBA was the lead investigator for the main defendant. DBA’s extensive investigations covered backgrounds on scientists, experts, consultants, surgeons and others.
Employee pharmacists sued LA County and numerous drug companies for exposure to dangerous drugs. DBA was hired by the large, coordinated defense team of over two dozen attorneys representing drug companies that may have provided anti-neoplastic products, all sued as allegedly the potential cause of a rare leukemia contracted by the plaintiff pharmacists. It was our job to provide an agreed understanding of the uses, procedures and operations involved.
In the lead paint litigation, mainly centered on the east coast, for major defendant ARCO, DBA put together a detailed history of the use, manufacture and distribution of lead-based commercial paint on the east coast. For the part of the litigation centered in New York City, we did substantial work to assist in a project to find all those in a position of government responsibility covering the use of lead paint in housing projects and other public locations some thirty years prior.
On behalf of client Bayer Aspirin, DBA was asked to find an original 1979 bottle of their product, with the original drug still inside and the original label intact. Though it seemed impossible, this item was finally located in a drug store product museum in upstate New York.
